By creating an account, accessing, or using DealLeaf (the "Service"), you agree to comply with and be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and DealLeaf. You must be at least 13 years of age to use this Service. If you are under 18, you must have parental or guardian consent.

DealLeaf is a community-driven platform that allows users in Canada to: (a) discover and share deals, discounts, and promotions; (b) vote on and comment about deals posted by other users; (c) interact with the community through discussions and feedback. The Service is provided free of charge to users.

To access certain features, you must create an account. You agree to: (a) provide accurate, current, and complete information; (b) maintain and update your account information; (c) keep your password secure and confidential; (d) notify us immediately of any unauthorized use; (e) be responsible for all activities under your account. You may not: (i) use another person's account; (ii) create multiple accounts; (iii) sell or transfer your account.

You agree to use the Service in compliance with all applicable Canadian federal and provincial laws. You agree NOT to: (a) post false, misleading, or fraudulent deals; (b) post content that is defamatory, obscene, harassing, or hateful; (c) violate any intellectual property rights; (d) impersonate any person or entity; (e) use automated systems (bots) to manipulate votes or content; (f) attempt to gain unauthorized access to the Service; (g) interfere with the proper functioning of the Service; (h) collect user information without consent; (i) post spam or unsolicited advertisements.

You retain ownership of content you post ("User Content"). By posting content, you grant DealLeaf a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your content in connection with operating the Service. You represent and warrant that: (a) you own or have rights to post the content; (b) your content does not violate any laws or third-party rights; (c) your content does not contain viruses or malicious code. We reserve the right to remove any content that violates these Terms or for any other reason at our sole discretion.

Deals are posted by users and DealLeaf does not verify the accuracy, availability, or pricing of deals. We are not responsible for: (a) the accuracy or completeness of deal information; (b) the quality, safety, or legality of products or services; (c) the ability of users or merchants to complete transactions; (d) any disputes between users and merchants. Links to third-party websites are provided for convenience only. We do not endorse or control third-party sites and are not responsible for their content or practices.

The Service, including all content, features, functionality, logos, trademarks, and software, is owned by DealLeaf and is protected by Canadian and international intellectual property laws. You may not: (a) copy, modify, or distribute our content without permission; (b) use our trademarks without authorization; (c) reverse engineer or decompile any aspect of the Service; (d) remove any copyright or proprietary notices.

You may not use the Service to: (a) advertise or promote your own business without permission; (b) engage in affiliate marketing schemes; (c) manipulate deals for commercial gain; (d) scrape or harvest data for commercial purposes; (e) compete with or replicate our Service.

We reserve the right, but not the obligation, to: (a) monitor and review user content; (b) remove or modify content that violates these Terms; (c) suspend or terminate accounts for violations; (d) investigate suspected violations; (e) cooperate with law enforcement. We are not liable for any failure to remove or delay in removing problematic content.

We may suspend or terminate your account and access to the Service at any time, with or without notice, for: (a) violation of these Terms; (b) fraudulent or illegal activity; (c) harm to other users or our reputation; (d) any other reason at our discretion. Upon termination: (i) your right to use the Service ends immediately; (ii) we may delete your account and content; (iii) you remain liable for any obligations incurred before termination. You may delete your account at any time through your profile settings.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY CANADIAN LAW, WE DISCLAIM ALL WARRANTIES INCLUDING: (a) merchantability and fitness for a particular purpose; (b) non-infringement of third-party rights; (c) uninterrupted, secure, or error-free service; (d) accuracy, reliability, or completeness of content; (e) prevention of viruses or harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY CANADIAN LAW, DEALLEAF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: (a) indirect, incidental, consequential, or punitive damages; (b) loss of profits, revenue, data, or goodwill; (c) service interruptions or data loss; (d) damages arising from user-generated content; (e) your reliance on deals or information on the Service. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 CAD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow limitation of liability for certain damages, so this may not fully apply to you.

You agree to indemnify, defend, and hold harmless DealLeaf and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any laws or third-party rights; (d) your user content; (e) any dispute between you and another user or third party.

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through: (a) good faith negotiation between the parties; (b) if unresolved, binding arbitration in accordance with the Arbitration Act of the applicable province; (c) arbitration shall be conducted in English or French in Montreal, Quebec. You and DealLeaf agree to waive any right to a jury trial or to participate in a class action. This does not prevent you from bringing claims to small claims court if eligible.

Nothing in these Terms limits or excludes any consumer protection rights you may have under Canadian federal or provincial consumer protection legislation, including the Consumer Protection Act (Quebec) or similar legislation in your province. If any provision of these Terms is found to be unenforceable under applicable consumer protection laws, that provision shall be modified to the minimum extent necessary to make it enforceable.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by: (a) posting the updated Terms with a new "Last Updated" date; (b) sending an email notification to registered users; (c) displaying a prominent notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and DealLeaf. Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect. Waiver: Our failure to enforce any right or provision does not constitute a waiver. Assignment: You may not assign these Terms. We may assign them to any successor or affiliate. Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control. Language: These Terms may be translated into other languages, but the English version shall prevail in case of conflicts.
